PRODUCT LIABILITY

The term “product liability” refers to the legal responsibility of manufacturers, distributors, suppliers, retailers, and other parties involved in the production or distribution chain of a product for injuries or damages caused by defects in the product. Below are a few instances where we’ll likely represent you in your claim for damages:

  • A car manufacturer releases a vehicle with faulty brakes that fail to engage properly, leading to accidents and injuries.

  • A pharmaceutical company markets a prescription medication without sufficiently warning healthcare providers and consumers about serious side effects or risks associated with its use.

  • A manufacturer releases a smartphone model with a defective battery that overheats and catches fire, causing property damage and burn injuries to users.

  • A food processing company distributes a batch of contaminated food products contaminated with harmful bacteria, leading to widespread foodborne illness outbreaks.

  • A toy manufacturer produces a line of children's toys with small parts that pose choking hazards to young children, despite safety regulations mandating age-appropriate design.

  • A medical device manufacturer releases a hip replacement implant with a design flaw that leads to premature wear and tear, causing device failure and tissue damage in patients.

  • A household cleaning product manufacturer uses toxic chemicals in its products without providing adequate warnings or safety instructions to consumers, resulting in chemical burns or respiratory issues.

  • A construction company constructs a residential building using substandard materials or improper construction techniques, leading to structural defects such as cracks in the foundation, walls, or ceilings.

If you’ve become victim to an injury sustained (at no fault of your own) with a product, please give us a call so we can get you the compensation you deserve.

Preserving Your Product Liability Claim

If you become injured while on someone’s property, at no fault of your own, please do the following:

  1. Get help. Call 911 and wait for emergency services to arrive.

  2. Take pictures of the area. If possible, take photographs of the dangerous condition that led to your injury. The more photographs, the better. If you’re too injured to take pictures, ask a friend, family member, or witness to take some for you.

  3. Gather witness information. Write down the names, addresses, and phone numbers of the other people who were present when the accident occurred.

  4. Seek medical help. Ensure that you visit a doctor and obey their treatment suggestions.

  5. Document everything. In addition to saving all bills, letters of correspondence, and reports surrounding your accident, write down what you remember as soon as possible while the memory is still fresh to ensure important details aren't lost.
