Common Questions and Answers
Q. What do I do after I’ve been hit?
A. Call the police, capture information of all parties and witnesses involved, seek medical attention, and call our office for a consultation.
Q. How do I know if I have a case?
A. There may not be a way for you to determine. Generally, if a report concludes “no fault” of your own, you have a case. For reports that determine you “partially at fault,” you may also have a case.
Q. What damages can I receive?
A. It depends on the cause of your personal injuries and the circumstances surrounding your injuries.
Q. Who pays my medical bills?
A. Depends on the circumstance. It could be your auto insurance company, the at-fault’s auto insurance company, your health insurance company, or your personal injury settlement.
Q. Are all personal injury claims based on negligence?
A. The majority of claims are but not all. Other claims may include reckless behavior, intentional misconduct, or strict liability.
Q. Will I have to go to trial?
A. Depends. Fortunately, most cases don’t make it to trial. However, trial is always on the table, especially if the insurance company denies your claim for injuries.
Q. Can I file a lawsuit without an attorney?
A. Yes. You may file your claim “pro se.” However, it’s highly discouraged considering the knowledge and experience required to fully articulate the legalities of your claim.
